Terms of Service

These terms and conditions ("Agreement") outline the general terms and conditions for your use of the "Exocus Focus" software, Exocus Focus official website https://byland.work/exocus, and other related websites and services (collectively referred to as "Service"). This Agreement is legally binding between you ("User," "You," or "Your") and the operators of Exocus Focus ("Operator," "We," or "Our"). By accessing and using the Service, you acknowledge that you have read, understood, and agreed to be bound by the terms of this Agreement. If you represent a company or another legal entity when entering into this Agreement, you declare that you have the authority to bind that entity to this Agreement, and in that case, the terms "User," "You," or "Your" shall refer to that entity. You acknowledge that this Agreement is a contract between you and the Operator, even if it is electronic and does not have your actual signature, and it governs your use of the Service.

Accounts and Membership

If you create an account on the Service, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under that account and any other actions related to it. We may, but have no obligation to, monitor and review new accounts before you log in and start using the Service. You may not share, transfer, rent, or otherwise transfer your account to another person. Membership accounts and related benefits are limited to the individual who registered the account. It is prohibited to transfer accounts and purchase rights to third parties in any form, including but not limited to transferring accounts, sharing account login information, or engaging in any actions that may allow others to use membership benefits. If you obtain an account through others' transfer, sale, or rental, the rights under that account will not be protected. If your way of obtaining an account violates our regulations, we have the right to take necessary measures, including but not limited to suspending, terminating, or restricting the use of the account, regardless of the rights under that account. We reserve the right to pursue legal responsibility for violators and will actively cooperate with law enforcement agencies in investigations. Users should consciously comply with relevant regulations and not acquire, disseminate, or use accounts through illegal means.

While the Service may link to other resources (such as websites, mobile applications, etc.), unless expressly stated here, we do not directly or indirectly imply any approval, connection, sponsorship, endorsement, or affiliation with any linked resources. We are not responsible for reviewing or evaluating, nor do we guarantee the content of any products or resources of any business or individual. Your use of the Service does not grant you any rights or licenses to copy or otherwise use any trademarks of the Operator or third parties.

Limitation of Liability

To the extent permitted by applicable law, under no circumstances shall the Operator, its affiliates, directors, officers, employees, agents, suppliers, or licensors be liable to any person for any indirect, incidental, special, punitive, consequential, or exemplary damages (including but not limited to loss of profits, revenue, sales, reputation, damage to the use of content, impact on business, business interruption, loss of expected savings, loss of business opportunities), regardless of the cause, under any liability theory, including but not limited to contract, tort, warranty, breach of legal duty, negligence, or other, even if the liable party has been informed of the possibility or foreseeability of such damages. To the extent permitted by applicable law, the total liability of the Operator and its affiliates, officers, employees, agents, suppliers, and licensors related to the Service will be limited to one Chinese yuan or the actual cash amount paid to the Operator by you in the week preceding the first event or occurrence giving rise to such liability, whichever is greater.

Indemnification

You agree to indemnify the Operator and its affiliates, directors, officers, employees, agents, suppliers, and licensors, making them free from any liability, loss, damage, or expense, including reasonable attorney's fees, related to any third-party allegations, claims, lawsuits, disputes, or demands arising from or related to your content, your use of the Service, or any intentional improper use of the Service by you.

Changes and Corrections

We reserve the right to modify this Agreement or its terms related to the Service at any time, effective when the updated version of this Agreement is posted on the Service. When we do so, we will revise the updated date at the bottom of this page. Continuing to use the Service after any such modifications shall constitute your agreement to such modifications.

Agreement to These Terms

You acknowledge that you have read and agree to all the terms and conditions of this Agreement. By accessing and using the Service, you agree to be bound by this Agreement. If you do not agree to comply with the terms of this Agreement, you are not authorized to access or use the Service.
